Instructions for Filing
The requirements for filing a Chapter 7 or Chapter 13 bankruptcy case are divided into two sections: minimum requirements and additional requirements. Each section contains the necessary PDF "fillable" forms.
The minimum requirements are the requirements that must be met to file the bankruptcy petition if circumstances arise where you cannot complete all required schedules and statements. Additional requirements must be met by some date after the filing of the petition, but may be met at the time of filing.
Each section contains the necessary forms. The following instructions are written for persons filing without legal counsel and are general guidelines to bankruptcy procedures.
First, read the information below:
- If you have not already, read Warning concerning Budget and Credit Counseling Requirement.
- Form B201A and Instructions, Notice to Individual Debtors Pursuant to 11 U.S.C. § 342 (b). Do not submit this form for filing.
- Federal Bankruptcy Rule 9037 - Privacy Protection For Filings Made with the Court. If you are filing any document with the Bankruptcy Court, other than Official Form B21 – Statement of Social Security, you are advised, for your own protection, to strictly follow Federal Bankruptcy Rule 9037, which says that certain personal information should be modified or redacted.
Next, complete the Minimum Requirements.
