Evidence Issues for Bankruptcy Lawyers - II

You are invited to attend a seminar, Evidence Issues for Bankruptcy Lawyers – II, presented by Judge Jacobvitz and Judge Thuma, together with members of their chambers staff.  The seminar will be held on Friday, June 9, 2017 from 10:00 a.m. to 12:00 noon in one of the thirteenth floor courtrooms in Albuquerque.  We have applied for CLE course approval from the New Mexico MCLE Board and anticipate that CLE credit will be given for attending the seminar.  Lunch will follow the seminar.  The New Mexico Federal Bench and Bar Fund will cover the entire cost of the CLE, including lunch and CLE credit, for attorneys admitted to the New Mexico Federal Bar.  The cost for attorneys who are not members of the New Mexico Federal Bar is $10 for lunch and $2 for CLE credit.  Legal Assistants are also welcome to attend and may purchase lunch for $10.  Payment will be collected at the seminar.  Please register by Tuesday, June 6, 2017 so we can be sure to order enough food.  


The seminar will cover:  
A.    FRE 602   Witness must testify from personal knowledge
B.    FRE 801   Definitions and Exclusions from Hearsay
C.    FRE 803   Exceptions to the Rule Against Hearsay – Regardless of  Whether the Declarant is Available as a Witness
D.    FRE 807   The Residual Exception to the Hearsay Rule
E.    FRE 1001 to 1004  Aspects of the Best Evidence Rule

    The evidentiary issues will be presented in a mock trial format, with chambers staff playing the roles of attorneys and witnesses and Judges Jacobvitz and Thuma making evidentiary rulings after polling the audience.  Judges Jacobvitz and Thuma will discuss the reasons for each evidentially ruling.
