December 1, 2013 Rule, Form and Fee Changes
On December 1, 2013, revisions to the Federal Rules of Bankruptcy Procedure, Bankruptcy Fee Schedule, and official Bankruptcy forms will take effect, unless Congress enacts legislation to reject, modify, or defer them. An informational packet outlining these changes has been posted on the Court’s web site:
Changes to the forms include significant revision to Schedules I and J. Law firms using bankruptcy preparation software applications need to insure the software is updated with the new forms for petitions submitted on or after December 1, 2013. Additionally national forms B3A (application to pay filing fee in installment payments) and B3B (application for waiver of the chapter 7 filing fee) have been modified. As of December 1, 2013, the Clerk’s Office will no longer provide local forms NM OF 3A or NM OF 3B. Use of the national forms will be required. Many bankruptcy software programs already pull the national forms rather than the local New Mexico forms. You will need to insure that the program you are using pulls the national forms. If your program does not, you will need to contact your software vendor to alert them to the national form requirement.
