Quick Note

 

  1. New Mexico Local Rule 1009-1 requires that:
    • the amended schedule restate the entire schedule;
    • if the amended schedule affects the information on the Summary of Assets and Liabilities (Official Form 106Sum or 206Sum), amend the summary and attach it to the amended schedule;
    • when an amended schedule is filed, the debtor must also file a notice of amendment specifying the amended or new information; and,
    • if the amendment adds entities/creditors, the debtor serves notice of the bankruptcy case to these additional parties.
  2. Debtor must sign and verify amended schedule(s).
  3. If deleting creditors from the schedules, file a Motion to Amend Mailing List to Delete Creditors. You will not use the Amended Schedules event.

 

 

  1. Click Bankruptcy Menu
  2. Click Miscellaneous
  3. Enter the case number.

      **When following the steps below, click the Next button to navigate to the next screen.

  4. Select Amended Schedules from the event list.
  5. At the Select the Party screen, select the debtor(s).
  6. Browse, verify, and attach the document.
    • Attach the signature page to the main document.
    • Attach the Amended Summary of Assets and Liabilities, if the amended schedule affects the information on this form.
  7. Select all item(s) being amended.

    Note: Do not use this event if the only document being amended is the Summary of Assets and Liabilities. Instead, use the event Summary of Assets and Liabilities under the Miscellaneous menu.

  8. Depending on the selection(s), a series of options is displayed.  
    • Click on the schedule listed below to see additional information specific to the schedule that is being amended.

    Schedule A/B

    Instructions: Input the total amount of Real Property and/or Personal Property as shown on the Amended Schedule.

     

    Reminder: File the Notice of Amendment to Bankruptcy Schedules (NM LF 1009-1(b)).

     

    Schedule C

    Instructions: Input the total value of claimed exemptions as shown on the Amended Schedule C.

     

    Reminder: When you are finished filing Amended Schedule C, file the Notice of Amendment to Bankruptcy Schedule C and Notice of Deadline to Object (NM LF 4003-1(e)).

     

    Schedule D

    Check all that apply:

      

    □ add creditors not previously listed

     

    Note: Under 28 U.S. Section 1930, a fee is due.

     

    Instructions: When prompted, enter the creditors being added in the box provided.

     

    □ change the amount of a debt

     

    Note: Under 28 U.S. Section 1930, a fee is due.

     

    □ change the classification of a debt

     

    Note: Under 28 U.S. Section 1930, a fee is due.

     

    □ change the address of a listed creditor

     

    □ change the address of an attorney for creditor listed

     

    □ add the name and address of an attorney for a creditor already listed

     

    Instructions: Input the Secured Claims Total as shown on Amended Schedule D.

     

    Reminder: File the Notice of Amendment to Bankruptcy Schedules (NM LF 1009-1(b)).

     

     

    Schedule E/F

    Check all that apply:

      

    □ add creditors not previously listed

     

    Note: Under 28 U.S.C. Section 1930, a fee is due.

     

    Instructions: When prompted, enter the creditors being added in the box provided.

     

    □ change the amount of a debt

     

    Note: Under 28 U.S.C. Section 1930, a fee is due.

     

    □ change the classification of a debt

     

    Note: Under 28 U.S.C. Section 1930, a fee is due.

     

    □ change the address of a listed creditor

     

    □ change the address of an attorney for creditor listed

     

    □ add the name and address of an attorney for a creditor already listed

     

    Instructions: Input the Unsecured Priority Claims Total and/or the Unsecured NonPriority Claims Total as shown on Amended Schedule.

     

    Reminder: File the Notice of Amendment to Bankruptcy Schedules (NM LF 1009-1(b)).

     

    Schedule G

    No fee is due to file Amended Schedule G.  However, if you are adding entities to Schedule G, file an Amended Mailing List to ensure the entity is added to the mailing list.

     

    Reminder: File the Notice of Amendment to Bankruptcy Schedules (NM LF 1009-1(b)).

     

    Schedule H

    No fee is due to file Amended Schedule H. However, if you are adding co-debtors, file an Amended Mailing List to add the co-debtor to the mailing list.

     

    Reminder: File the Notice of Amendment (NM LF 1009-1(b)).

    Schedule I

    If amending line 2, 6, or 12 on Schedule I, mark the check box as indicated.  Enter the amount(s) as shown on Line 2, Monthly gross wages, salary, and commissions, Line 6, Subtotal of payroll deductions, and/or Line 12, Combined monthly income when prompted.

    Schedule J

    If amending line 22c and/or line 23c, mark the check box as indicated.  Enter the amount(s) shown on Line 22c, Monthly expenses and/or Line23c, Monthly net income when prompted.
  9. If amending schedules D or E/F, the following screen appears:

     

  10. If adding creditors, changing the amount of a debt, or changing the classification of a debt, the fee screen appears.
  11. When adding creditors, a message displays:

    You will be presented with the opportunity to enter creditors on the next screen. You may want to copy and paste the creditor addresses from your text file.

  12. Reminder messages display.  When you complete this process, file the remaining documents (as necessary):
