Chapter 13 Plan

 

New Mexico Local Rule 3015-2 requires use of form NM LF 3015-2 for filing the chapter 13 plan.

When the plan and notice are filed with the petition, the Clerk's Office will process the Chapter 13 Plan and Notice of Deadline to Object to Confirmation for mailing to all creditors by the Bankruptcy Noticing Center (BNC).

For noticing purposes, NM LBR 3015-2 requires filers to use NM LF 3015-2(e)A when the plan is filed with the petition, otherwise use NM LF 3015-2(e)B

The page size of the plan and notice PDF documents must not exceed 9.5 inches X 12 inches.  PDF documents containing larger pages will not be processed by the BNC.

 

  1. Click Bankruptcy Menu
  2. Click Chapter 13 Plan
  3. Enter the case number.

    **When following the steps below, click the Next button to navigate to the next screen.

  4. Select Chapter 13 Plan from the event list, and then select each motion that is included in the Chapter 13 Plan.

    To select multiple events hold down the Ctrl key or Command key

    • Assume Lease or Executory Contract (Motion)
    • Avoid Lien (AV) (Motion)
    • Avoid Lien on Household Goods (AV) (Motion)
    • Valuation (BIF) (Motion)
    • Value Security and Limit Secured Claim (STR) (Motion)
  5. At the Select the Party screen, select the Debtor(s).
  6. If motions are included in the plan, you will receive the following screen for each motion you selected:

    How many motions to assume lease or executory contract are included in the plan?
    Note :If you have more than five (5) motions to assume, please contact the Clerks Office for further instructions.

    • Choose the total number of motions included.
  7. Browse, verify, and attach the document.
  8. If a Plan has previously been filed, the following screen appears. Make the appropriate selection.

    Is the plan being Amended or Modified?

    • Amended
    • Modified

    Note: Based on the plan confirmation status, a warning message may display. For instance, if the plan has been confirmed and "Amended"was selected, the warning message appears. Click Next to proceed, or use the back button to return to the previous screen and change the selection.

  9. Docket Text :Modify as Appropriate

    Enter in the contract holder, lien holder, and information on motion for valuation if necessary.
