Motion to Divide Joint Case

Requirements for Asset Cases

1. Include information in the motion regarding how the assets will be allocated between the divided cases.

 

2. The motion must be noticed out. File a Notice of Deadline to File Objections (21 + 3 days).

  1. Click Bankruptcy Menu
  2. Click Motions/Applications
  3. Enter the case number.

    **When following the steps below, click the Next button to navigate to the next screen.

  4. Select the appropriate event from the event list:
    • Divide Joint Chapter 11 Case (Motion)
    • Divide Joint Chapter 12 Case (Motion)
    • Divide Joint Chapter 13 Case (Motion)
    • Divide Joint Chapter 7 Case (Motion)
  5. Select the appropriate debtor as the party.
  6. Browse, verify, and attach the document.
  7. If filing in a chapter 7 case, the following question appears:

    In a chapter 13 case:

    Select Yes or No.

  8. For a Chapter 7: If Yes is selected, make the appropriate fee selection.

    Note: If WAIVED is selected, an Order must be entered on the docket which waives the filling fee for the motion to divide joint case as prescribed by the Judicial Conference under 28 U.S.C. Section 1930.

    For a Chapter 13 case, NOT DUE is the only option.

    Follow the instructions on the next screen.

    • Enter NOT DUE in the Receipt # Box

    OR

    • Enter WAIVED in the Receipt # Box
  9. If No, verify the fee amount being charged.
  10. Review final docket text.
