Chapter 13 Forms for Individual Debtors

 

In addition to the following forms, a List of Creditors is required at the time of filing the petition.

 

  1. The petition PDF should be filed with all the schedules and statements required by 11 U.S.C. § 521(a)(1). The petition PDF file should include the following documents:
    • Voluntary Petition for Individuals (OF Form 101) - Required at case opening.
    • Summary of Your Assets and Liabilities and Certain Statistical Information (OF Form 106Sum) - Required at case opening or within 14 days of filing petition.
    • Schedules A/B - J (OF Forms 106A/B - 106J) - Required at case opening or within 14 days of filing petition.
    • Declaration About an Individual Debtor's Schedules (OF Form 106Dec) - Required at case opening or within 14 days of filing petition.
    • Statement of Financial Affairs for Individuals (OF Form 107) - Required at case opening or within 14 days of filing petition.
    • Ch 13 Statement of Your Current Monthly Income and Calculation of Commitment Period (OF Form 122C-1) - Required at case opening or within 14 days of filing petition.
    • Ch 13  Calculation of Your Disposable Income - if disposable income is determined under 11 U.S.C. § 1325(b)(3) If applicable (OF Form 122C-2) - Required at case opening or within 14 days of filing petition.
  2. List of Creditors File - Required at case opening

    Prepare the list of creditors in .txt format. Ensure that New Mexico Taxation and Revenue Department is added to the list, using the address listed below.

The following documents should be filed separately, unless otherwise stated.

  1. Individual Debtor's Omnibus Signature Page and Declaration (NM LF 902) - Required at case opening unless debtor signs each Official Form separately. It should be scanned and printed to pdf for uploading as either an attachment to the petition or as a separate document immediately after filing the petition.

 

  1. Statement About Your Social Security Number (OF Form 121) - Required at case opening or within 14 days of filing petition. This document must be hand signed by the debtor(s), unless the box for Statement of Social Security Number is checked on the Signature Page: Declaration by Debtor (NM LF 902).

 

  1. Certificate of Credit Counseling - Required at case opening or within 14 days of filing petition. File a Certificate of Credit Counseling for each debtor, or
    • a Motion for Determination Regarding Exemption per Section 109(h)(4), or
    • a Motion for Determination Regarding Exigent Circumstances per Section 109(h)(3)(A)

 

  1. Certification/Statement Regarding Marital Status (NM LF 1002-1) - Required for a single debtor, at case opening or within 14 days of filing petition. This document must be hand signed by the debtor, not an s/electronic signature.

 

  1. Disclosure of Compensation (Director's Form 2030) - Required at case opening or within 14 days of filing petition. s/ electronic signature by attorney is acceptable.

 

  1. Chapter 13 Plan (NM LF 3015-2) - Required at case opening or within 14 days of filing petition.

 

  1. Notice of Deadline to Object to Chapter 13 Plan (NM LF 3015-2(e)A) (filed with the petition) or (NM LF 3015-2(e)B) (filed after petition date) - Required at case opening or within 14 days of filing petition.
