Pending Changes in Bankruptcy Forms
As a result, the following changes will be made to our Court’s CM/ECF System on December 1, 2018.
Rule 3002.1 Claim Supplements (Fed. R. Bankr. P. 3002.1(b)(1))
- Notice of Payment Changes that arise from a home-equity line of credit (HELOC) should be filed in the same manner as Notice of Payment Changes that arise from a mortgage.
- CM/ECF electronic filers may use the event Mortgage Payment Change – also for HELOC (Notice).
- Creditors may use the File a Claim Supplement program on our website at http://nmb.uscourts.gov/claims-e-filing. Select the radio button option Supplement 1 – Notice of Mortgage Payment Change (also for HELOC).
Additionally, two new events are being added to CM/ECF:
- Motions/Applications - Determine Validity of Payment Change (Motion). This event is added for use by parties to object to a payment change. (Fed. R. Bankr. P. 3002.1(b)(2))
- Appeal - Supplemental Statement by a Party Re: Certification of Direct Appeal. This event is added for use by parties to file a short supplemental statement regarding the merits of the certification. (Fed. R. Bankr. P. 8006(e)(2))
