Federal Bankruptcy Rule and Form Changes and Local Rule Changes Effective December 1, 2025

Information on the Federal Rule changes that go into effect December 1, 2025, is available on the U.S. Courts website:

Among other things, practitioners should be aware of big changes to Rule 3002.1 (Notice Relating to Claims Secured by a Security Interest in the Debtor’s Principal Residence in a Chapter 13 Case) 

The rule is amended to encourage a greater degree of compliance with its provisions and to allow assessments of a mortgage claim’s status while a chapter 13 case is pending in order to give the debtor an opportunity to cure any post-petition defaults that may have occurred. Stylistic changes are made throughout the rule, and its title and subdivision headings have been changed to reflect the amended content. 

Tiffany M. Cornejo, Chapter 13 Trustee, plans to hold a training session regarding the rules changes relating to chapter 13 practice. The date, time, and place of the training will be announced once the training is scheduled.

December 1, 2025, Updated Local Rules

The Bankruptcy Court posted for review and public comment proposed new and revised local bankruptcy rules.  No comments were received during the comment period. The Bankruptcy Court adopted the new and revised New Mexico Local Bankruptcy Rules, with an effective date of December 1, 2025.

A copy of the Order Adopting Local Rules, with an effective date of December 1, 2025, together with the New Mexico Local Bankruptcy Rules as adopted, and revised and new local forms created as a result of the amendments to the New Mexico Local Bankruptcy Rules are posted to the Bankruptcy Court’s public website:
