Under the applicable standard for evaluating a motion to dismiss for failure to state a claim, the complaint must contain enough facts to state a cause of action that is "plausible on its face." To withstand dismissal, a plaintiff must sufficiently allege all facts necessary to support the required elements under the legal theory proposed. CredAmerica, LLC v. Dismissal of a chapter 13 bankruptcy case terminates the automatic stay immediately.
